What is "On the Job"?

An on the job car accident is one that happens while you're on the clock performing work-related activities. Accidents that happen as you commute to and from work usually don't qualify as work-related accidents. Car crashes that happen during lunch hours aren't considered "on the job" either. If you're hurt in a car crash that's not related to work, your only option may be to file a claim against the at-fault driver.

If your employer or supervisor asks you to transport or pick up something for work, then you are performing work-related activities. Your actions during this time may be covered by workers' compensation benefits.

Steps You Can Take

If you're injured while driving for your employer, it is advisable to:

  • Call the authorities and remain at the scene of the crash
  • Notify your employer of the accident and inform him or her that you will need medical attention
  • Inquire if there is a specific doctor or medical facility to which your employer's insurance prefers you go
  • Gather contact information from everyone involved in the crash as well as anyone who witnessed the incident
  • Collect evidence from the crash site including photos of the vehicles and your injuries

Proving Your Work Related Car Accident Case

It is important that make sure your employer contacts their insurance provider on your behalf. Anyone injured in a car accident on the job should be eligible for compensation, even if they're hurt away from the workplace. You'll have to prove you were performing work-related activities at the time of the crash, and that those injuries needed medical attention.

Workers’ compensation should cover all the resulting medical bills and a portion of your lost wages. A successful workers' compensation claim will not cover all your losses. This is why many injured victims of on the job car accidents find it beneficial to also file a claim against the at-fault driver.

You can file a personal injury claim against the driver responsible for your injuries. Plaintiffs in such cases must show that the at-fault driver's negligence contributed to the crash. Unless you explore all your legal options, it's likely that you won't get fair compensation for the injuries you've suffered. DO NOT accept any settlements or make any legally binding decisions without reviewing your options with a workers' compensation attorney.
