New Jersey Workers’ Compensation Insurance

It is mandatory for employers to carry workers’ compensation insurance in New Jersey. This ensures that employees are given the necessary care and funding they need to avoid undo financial hardship while out of work, and to pay medical expenses.

The cause of the workplace injury is not important. All that must be demonstrated to have a workers’ compensation case in New Jersey is that the injury took place during the course of employment. Fault is largely irrelevant; though there are cases in which employee negligence does void workers’ compensation, such as being intoxicated while on the job.

If an on-the-job injury does occur, employers must see to it that the injured party is given medical attention. If a company-approved physician deems that the employee cannot perform his or her job on a daily basis, then the company must provide medical care and temporary disability benefits to the employee. TDB benefits in New Jersey typically are 70% of the employee’s average weekly wage prior to the compensable injury. Injured workers in New Jersey can also apply to the Division of Workers’ Compensation in Trenton for a lump sum monetary award if the injury is permanent in nature.
