Bringing a Personal Injury Claim for a Motorcycle Accident

In order to bring a personal injury claim for a motorcycle accident, you must be able to show that another party was responsible for causing the accident and your harm. If you were primarily responsible for causing the accident, you will not have standing to bring a claim and recover damages. In order to be successful in your lawsuit, you will have to demonstrate that the other driver or another party was negligent and that their negligence was the cause of your injuries. A driver is negligent when they breach their duty of care by breaking the law or driving recklessly. In motorcycle accidents, driving under the influence is often a factor, and this would serve to establish negligence. You will also have to show that you suffered both physical and financial harm as a result of the crash. This can be established with medical bills, proof of expenses, and evidence of lost wages.
