Challenges with Lyft

It makes sense that people are excited about Lyft. It’s convenient to get a ride that does not cost as much as a taxi. You can get some work done while your driver takes you where you need to go or request a ride back from a party after a night of drinking without breaking the bank. For most people, this service works great. The problem with companies such as Lyft is what happens in the event of a car accident.

One of the reasons why taxi and limousine companies are expensive is because they must follow many rules and regulations. Their drivers are subject to thorough background checks and they’re screened for drugs. The vehicles are all owned and maintained by the taxi service company and they are often inspected for mechanical and other problems. The taxi company’s insurance policy covers passengers in the event of a crash.

Rideshare companies like Lyft DO NOT provide these protections.

When you’re in a Lyft vehicle, you are riding in a vehicle owned, maintained, and insured by the driver. Lyft performs an inspection on their vehicles before accepting new drivers, but they DO NOT regularly inspect the vehicles Lyft drivers use. There’s no way for the company to know if their drivers are properly maintaining their vehicles after the initial inspection. And, it’s not always clear who is responsible in the event of an accident.

New Jersey Lyft Accident Attorney Protecting Your Rights

Lyft has insurance that covers vehicles transporting Lyft customers. They also require drivers to have insurance. But not all personal insurance policies cover commercial use, and Lyft considers itself a ridesharing application, and not a taxi service. This can result in a grey area legally where the injured victims of the Lyft car accident may struggle to get the support they need.

The driver’s insurance provider may deny the claim because the vehicle was being used for commercial use. Lyft may deny the claim since they don’t own the vehicle, and the driver is merely an independent contractor and not an employee.

It’s in your best interest to seek the guidance of an experienced New Jersey Lyft car accident lawyer. You may be entitled to support for damages including medical bills, lost wages, pain and suffering and emotional distress.

Lependorf & Silverstein, P.C. will help you secure fair and full compensation for all your losses.
